Terms of Service
Welcome to Mfadhili, a crowdfunding platform owned by Tari Africa Platforms Ltd a registered Company Under the Laws of Kenya. By accessing or using our platform, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.
1. Definitions
  • Platform: Refers to the Mfadhili website and associated services.
  • User: Any individual or entity using Mfadhili, including campaign organizers and donors.
  • Campaign Organizer: A user who creates a fundraising campaign on the platform.
  • Donor: A user who contributes to a fundraising campaign.

2. Eligibility
  • You must be at least 18 years old to create a campaign or donate.
  • Users must provide accurate, current, and complete information during registration.

3. Account Responsibilities
  • You are responsible for maintaining the confidentiality of your account information.
  • You agree to notify Mfadhili immediately of any unauthorized access or breach of security.

4. Campaigns
  • Campaigns must comply with Kenyan laws and the platform’s guidelines.
  • Campaign Organizers are solely responsible for the content, accuracy, and legality of their campaigns.
  • Mfadhili reserves the right to review, approve, or reject campaigns.

5. Donations
  • Donations are voluntary and non-refundable unless there is evidence of fraud or misrepresentation.
  • Payment processing fees may apply and will be disclosed at the time of donation.

6. Prohibited Activities
Users may not:
  • Create campaigns for illegal, unethical, or misleading purposes.
  • Use the platform to promote hate speech, discrimination, or violence.
  • Interfere with the platform’s functionality or engage in fraudulent activities.

7. Fees, Payments & Withdrawals
  • Mfadhili may charge service fees of 3% on total amount donated as, which will be disclosed to each Party.Whereas Processing fees or Transactional Charges will according to the Service Provider.
  • Payment processing is handled by third-party services such as Mpesa, Paystack, and Stripe, and their terms apply.
  • All Withdrawals will take 1-4hours or Longer Depending on the Settlement account and will be settled to the Nominated Account/Number during Sign Up.

8. Dispute Resolution
  • Mfadhili is not liable for disputes between Campaign Organizers and Donors but may mediate at its discretion.

9. Privacy
  • Mfadhili respects user privacy and handles personal data according to its Privacy Policy.

10. Termination
  • Mfadhili reserves the right to suspend or terminate user accounts for violations of these terms.

11. Limitation of Liability
  • Mfadhili is not liable for any damages resulting from the use or inability to use the platform.

12. Modifications to Terms
  • Mfadhili reserves the right to modify these Terms of Service at any time. Changes will be communicated to users.
